By accessing or using our Website and Application, you agree to be bound by these terms, which establish a contractual relationship between SKOR and you, the user.

For the purposes of these Terms and Conditions:

Your use of our Website and Application as either a Landlord or a Tenant constitutes your agreement to these Terms and Conditions. If you do not agree to these terms, you may not access or use our services.

Please read these Terms and Conditions carefully, as they contain important information about your legal rights, remedies, and obligations. By accessing or using the SKOR Website and Application, you agree to comply with and be bound by these Terms and Conditions. We reserve the right to modify or update these Terms of Use at any time and without prior notice, whether for regulatory requirements, technical reasons, changes in our services, or other strategic decisions. We recommend users periodically review these terms, as continued use of the Website and Application after changes indicates acceptance of the updated terms.

  1. SERVICES

    SKOR, through its Website and Application, provides the following services:

    • Offer users a service of rental and property management for real estate technological solutions.
    • Facilitate the rental of properties to Tenants.
    • Help Tenants find suitable properties within the SKOR network.
    • Provide access to additional services related to the property.
    • Provide a platform for utility bills payments.
    • Offer the functionality of monthly rent payment directly to the Landlord through the SKOR platform.
    • Access to third-party insurance policies through the SKOR platform.
  2. TENANT RESPONSIBILITIES
    • Tenants are responsible for providing accurate and current personal and financial information to SKOR. This includes promptly updating any changes to their information to ensure its accuracy.
    • Tenants must understand and agree to the processing of their personal data by SKOR for specified purposes, such as credit scoring, property listings, and, if requested, accessing financing options. This includes consenting to the sharing of their data with Landlords for the purpose of tenancy evaluations.
    • Tenants are responsible for maintaining the confidentiality of their account details, including passwords. They should take reasonable steps to prevent unauthorized access to their account and personal data.
    • Tenants must adhere to all relevant policies and guidelines set forth by SKOR, particularly those related to data protection and privacy. This includes using the platform's services in a manner that respects the privacy and data rights of other Users and Landlords.
    • In the event of any suspected misuse of their personal data or unauthorized access to their account, Tenants are responsible for promptly reporting these issues to SKOR. This enables timely action to safeguard their data.
    • Tenants should carefully review and understand SKOR's data practices as outlined in the Privacy Policy, including how their data is collected, used, stored, and protected.
    • Tenants agree to make appropriate and lawful use of the Website and the Application, in accordance with the applicable legislation and these Terms of Use.
    • Tenants must be at least 18 years old to access and use the Website and the Application.

    The Tenant must not:

    • Engage in unauthorized or fraudulent use of the Website.
    • Attempt to access restricted resources of the Website or the Application.
    • Use the Website or the Application for illegal purposes or in a way that contravenes these Terms of Use.
    • Cause damage to the Website, the Application, or the systems of our suppliers or third parties.
    • Introduce or disseminate computer viruses or any other malicious software that may harm SKOR's systems, our suppliers, or third parties
    • Attempt to access, use, or manipulate SKOR's data or the data of third-party providers and other Users.
    • Reproduce, copy, distribute, transform, or modify the contents, unless authorized by the respective owner or permitted by law.
    • Attempt to access and/or use the email accounts of other users or modify their messages.
    • Share their username and password with unauthorized third parties. Unauthorized access must be reported immediately to SKOR

    Tenants agree to provide the necessary information to enable SKOR to provide its services effectively.

  3. LANDLORD RESPONSIBILITIES
    1. Landlords are required to comply with all applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD). This includes, but is not limited to, processing personal data lawfully, fairly, and in a transparent manner.
    2. Personal data obtained from Users (Tenants) through SKOR must be used solely for the purpose of evaluating potential tenancy agreements. Advertisers must not use this data for any unrelated purposes without obtaining explicit consent from the Users.
    3. Landlords must maintain the confidentiality of all personal data they access. They are responsible for implementing appropriate security measures to prevent unauthorized access, disclosure, alteration, or destruction of personal data.
    4. Landlords are prohibited from sharing Tenants’ personal data with third parties, unless required for legitimate tenancy-related purposes and in compliance with relevant data protection laws. In such cases, Landlords must ensure that third parties adhere to similar standards of data protection.

    The Landlord must not:

    • Engage in unauthorized or fraudulent use of the Website.
    • Attempt to access restricted resources of the Website or the Application.
    • Use the Website or the Application for illegal purposes or in a way that contravenes these Terms of Use.
    • Cause damage to the Website, the Application, or the systems of our suppliers or third parties
    • Introduce or disseminate computer viruses or any other malicious software that may harm SKOR's systems, our suppliers, or third parties.
    • Attempt to access, use, or manipulate SKOR's data or the data of third-party providers and other Tenants
    • Reproduce, copy, distribute, transform, or modify the contents, unless authorized by the respective owner or permitted by law.
    • Attempt to access and/or use the email accounts of other users or modify their messages.
    • Share their username and password with unauthorized third parties. Unauthorized access must be reported immediately to SKOR
  4. AUTHORIZATION TO ACCESS CREDIT INFORMATION

    The Tenant hereby grants SKOR explicit consent to access, retrieve, and use their personal and credit information from credit bureaus and financial institutions as required for the purpose of providing credit scoring services to potential Landlords.

    This authorization is in compliance with Ley Orgánica 3/2018, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD) and the European Union’s General Data Protection Regulation (GDPR).

  5. USE OF CREDIT INFORMATION
    1. Credit information provided by SKOR to Landlords will be strictly for the purpose of evaluating the Tenants’ creditworthiness and suitability for tenancy.
    2. The Tenant acknowledges that SKOR does not assume any responsibility for the decisions taken by Landlords based on the provided credit information. While SKOR provides credit information to Landlords, it does not influence or bear responsibility for the decisions made by Landlords based on this information. Landlords are responsible for their own decisions and compliance with relevant laws and regulations
    3. SKOR reserves the right to collect, process, and analyze credit information pertaining to Tenants for the purpose of providing credit scoring services. This includes gathering data from credit bureaus, financial institutions, and other relevant sources.
    4. SKOR is entitled to provide credit information to Landlords, strictly for the purpose of assisting them in evaluating the Tenants’ creditworthiness and suitability for tenancy. This provision is subject to the consent of the Tenant, where required by law, and in compliance with GDPR and LOPDGDD.
    5. SKOR commits to ensuring that the credit information it processes and provides is accurate and up-to-date. SKOR will take reasonable steps to rectify any inaccuracies or errors in the credit information in a timely manner.
    6. . SKOR will retain credit information only for as long as is necessary for the purposes for which it was collected, in compliance with applicable data retention laws and regulations. Upon the expiry of this period, or upon the Tenants’ request where applicable, the data will be appropriately deleted or anonymized.
  6. OTHER SERVICES’ DATA PROCESSING
    SKOR offers additional services, including:
    1. Payment of utility bills: A convenient feature allowing Tenants to manage and pay household bills such as electricity, water, and internet directly through the SKOR platform.
    2. Access to third-party insurance policies: We facilitate access to a variety of insurance policies offered by third-party providers, enabling users to find and choose insurance solutions that best meet their needs.
    3. Payment of rental installments: Tenants can pay their monthly rent installments directly to property owners through our secure and efficient SKOR platform..
    4. The data collected for these services will include, but may not be limited to:

    • Transaction and payment details for household bill payments and rental installments.
    • Personal information required for accessing third-party insurance policies, which may include contact details, demographic information, and other relevant data required by insurance providers.

    SKOR commits to using this data solely for the purpose of providing the aforementioned services, improving user experience, and as required by law

  7. USE OF TENANTS INFORMATION FOR ACCESS TO FINANCING
    • SKOR, in its capacity to facilitate credit scoring services, may also assist Tenants in accessing financing options, but only upon the explicit request of the Tenant.
    • When a Tenant request such assistance, they provide SKOR with explicit consent to use their personal and financial data, initially collected for credit scoring, to explore potential financing opportunities.
    • This process involves disclosing relevant data to financial institutions and lending partners, under strict confidentiality and compliance with GDPR and LOPDGDD. SKOR is committed to ensuring the highest standards of data security and confidentiality in this regard.
    • It is important to note that SKOR's role is limited to facilitating the availability of financial options and does not extend to influencing decisions made by financial institutions.
    • Tenants have the right to full transparency about the use of their data in this context and may amend or withdraw their consent at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal.
    • SKOR will maintain accurate records of all consents and data processing activities for auditing and compliance purposes, in line with legal and regulatory requirements.
  8. DATA PRIVACY AND PROTECTION

    SKOR commits to maintaining the highest standards of data privacy and will implement appropriate technical and organizational measures to protect the user's personal data against unauthorized or unlawful processing and against accidental loss, destruction, or damage. The user’s data will be processed in accordance with the provisions of the LOPDGDD and the GDPR, and as reflected in SKOR’s Privacy Policy. The collection and processing of personal data during the use of our Website and Application are governed by SKOR's Privacy Policy, which is an integral part of these Terms of Use.

  9. ACCURACY OF INFORMATION

    The user assures that all personal and financial information provided to SKOR is accurate, complete, and up-to-date. The user agrees to promptly update any changes to this information.

    Providing false or misleading information may lead to the termination of this agreement and potential legal action.

  10. LIMITATION OF LIABILITY

    SKOR does not guarantee the continuous availability of the Website and the Application. Therefore, SKOR is not liable for any damages arising from:

    • The unavailability or inaccessibility of the Website or the Application
    • Interruptions in the operation of the Website, the Application, or technical failures, including disruptions, disconnections, delays, or blockages caused by phone line deficiencies, data centers, internet systems, or other electronic systems.
    • The accuracy, completeness, or currency of information not created by SKOR.
    • Damages caused by third-party interference beyond SKOR's control.

    SKOR does not guarantee the absence of viruses or other malicious elements introduced by third parties that may affect Users' systems or electronic documents. Consequently, SKOR is not responsible for any damage resulting from the presence of such viruses or elements.

    Additionally, SKOR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, service interruption, computer damage, or system failure related to this agreement, except where prohibited by law.

  11. RIGHT TO DISPUTE

    The Tenants retains the right to dispute the accuracy of the credit information provided by SKOR. In such cases, SKOR is obliged to investigate and rectify any inaccuracies in a timely manner, adhering to GDPR and LOPDGDD guidelines.

  12. TERMINATION OF AGREEMENT

    This agreement remains in effect until terminated by either the User or SKOR. The User may terminate this agreement at any time by providing written notice to SKOR. Upon termination, SKOR will cease to use the User’s data for any purpose except as required by law or for legitimate business purposes under the applicable legal provisions.

    SKOR reserves the right to terminate this agreement immediately, without notice, in the event of the User's breach of any of these terms, especially regarding the accuracy and legality of the information provided.

  13. EXERCISE OF DATA SUBJECT RIGHTS

    In compliance with Articles 15 to 22 of the GDPR and corresponding articles of the LOPDGDD, the User may exercise their rights to access, rectify, erase, or object to the processing of their personal data.

    1. SKOR shall facilitate the exercise of these rights by providing the User with adequate means, such as a user interface on their platform or direct contact with the Data Protection Officer, to request access, rectification, erasure, or portability of their personal data.
    2. Upon receiving a request from the User to exercise any of the aforementioned rights, SKOR shall respond without undue delay, and in any event within one month of receipt of the request. This period may be extended by two further months where necessary, taking into account the complexity and number of the requests. SKOR shall inform the User of any such extension within one month of receipt of the request, together with the reasons for the delay.
    3. When the User exercises their right to erasure, SKOR shall take reasonable steps to inform other entities (who have been disclosed the personal data) of this request, ensuring the erasure extends to all copies or replications, unless otherwise mandated by law.
    4. In cases where the User objects to the processing of their personal data, SKOR shall cease processing unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the User, or for the establishment, exercise, or defense of legal claims.
    5. SKOR commits to maintaining an internal record of data subject requests and the corresponding actions taken, ensuring transparency and accountability in its data processing activities.
    6. All communications and actions taken under Articles 15 to 22 of GDPR and corresponding LOPDGDD provisions shall be provided free of charge to the User. However, SKOR may charge a reasonable fee for further copies requested by the User, or if requests are manifestly unfounded or excessive, particularly if they are repetitive.
  14. AUTOMATED DECISION-MAKING PROCESSES
    1. The Tenant explicitly acknowledges and consents to the profiling activities conducted by SKOR as part of its credit scoring services. Such profiling includes the analysis of personal financial data and other relevant information to evaluate creditworthiness. This consent is in accordance with Article 22 of the GDPR and corresponding articles of the LOPDGDD.
    2. SKOR affirms that its profiling activities are conducted for legitimate and lawful purposes, specifically for assessing the credit risk associated with potential Tenants
    3. SKOR ensures that the profiling is based on accurate, current, and relevant data, and takes reasonable steps to avoid inaccuracies.
    4. SKOR commits to transparency in its profiling practices. Detailed information about the profiling process, including the logic involved, the significance, and the envisaged consequences of such processing for the Tenant, will be provided upon request.
    5. Profiling at SKOR does not solely rely on automated processing. SKOR implements measures to safeguard the Tenant’s rights, freedoms, and legitimate interests, including the provision for human intervention in the decision-making process. Users have the right to express their point of view and to contest decisions made based solely on automated processing.
    6. SKOR provides an option for the Tenant to opt-out of profiling activities. Upon opting out, SKOR will use alternative methods, which may include manual processing, for credit assessment purposes
    7. In the event of adverse decisions based on profiling, SKOR shall provide the Tenant with the opportunity to obtain human intervention, to express their viewpoint, and to challenge the decision.
    8. SKOR will regularly review and audit its profiling algorithms and procedures to ensure non-discrimination, accuracy, and compliance with GDPR and LOPDGDD.
  15. THIRD-PARTY LINKS

    SKOR does not control the content of third-party sites accessible through links on our Website or Application. We are not responsible for the information contained on such sites or any consequences resulting from that information. Links to third-party sites are provided for users' convenience and should not be construed as endorsement or sponsorship by SKOR. We 9 do not guarantee the accuracy, ownership, validity, or legality of linked sites and their content.

  16. COMPENSATION

    If SKOR, its group companies, suppliers, or any other party involved in the creation and distribution of the Website and Application incur damages, losses, or costs due to Users' breaches of these Terms of Use, users are obligated to compensate for the damages caused. This includes situations where third parties may make claims against SKOR or its group companies due to users' actions. Users will indemnify SKOR and its group companies for any expenses, costs, or damages resulting from their actions.

  17. INTELLECTUAL AND INDUSTRIAL PROPERTY

    The Website and Application, along with their contents, are the property of SKOR and are protected under Spanish, EU, and international copyright, trademark, and intellectual property laws. Access to the Website does not grant authorization or a license to use its content and rights.

    Certain trade names, brands, logos, slogans, and other materials displayed on the Website and Application are duly registered. Users are not authorized to use these elements, as they remain the property of SKOR or other entities.

    Reproduction, distribution, transformation, public communication, assignment, or exploitation of the Website's content, in whole or in part, without prior written consent from SKOR and, if applicable, the rights' owner, is strictly prohibited.

    Users may print copies of individual Website pages for personal, non-commercial use, provided they do not alter copyright, trademark, or other identification notices. Any other form of copying, whether electronic, paper, or otherwise, is entirely prohibited.

    SKOR reserves the right to pursue legal actions, as permitted by Spanish and foreign law, against any unauthorized use or infringement of its intellectual and industrial property rights.

  18. NOTIFICATIONS

    SKOR will send notifications through the email address provided by users.

  19. SAFEGUARD AND INTERPRETATION

    These Terms of Use form an agreement between users and SKOR. If any provision is declared illegal, invalid, or unenforceable by competent authorities, it will be interpreted to align with the original intention. Such a declaration regarding one or more clauses will not affect the validity of the remaining provisions. SKOR's failure to enforce any term does not waive its right to demand strict compliance in the future.

  20. APPLICABLE LAW AND JURISDICTION

    This Website, its content and services, as well as the relationship between Users and SKOR, are subject to Spanish law and these Terms of Use. For any questions or disputes arising from this agreement, the parties agree to submit to the jurisdiction of the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction.
